BJYM through the President Anurag Thakur, Member of Parliament, has moved the National Human Rights Commission by filing a Human Right Petition on Monday praying for strict action to be taken against the Govt. of State of J&K and its functionaries for gross violation of human rights and fundamental rights of the members of the BJYM who recently were subjected to inhumane torture and mal treatment in the state of Jammu and Kashmir on 26th of January for being the members of the Ekta Yatra organized by the BJYM
These following BJYM members were illegally arrested and tortured by the police officials of the State of Jammu and Kashmir:
Mr. Bhrigu Bakshipatra, Mr. Rajesh Chowdhary, Mr. Mohan Reddy, Mr. Suresh Bagashia, Mr. Shyantanam Basu, Mr. Mrigang Berman, Mr. R. P. Singh, Smt. Sikha Rai, Mr. Pradeep Singh Vaghela, Mr. Harsh Sanghavi, Mr. Alpesh, Mr. Pandya Shashikant, Mr. Gigar Kheda, Mr. Bhim Ji Jodani, Mr. Momayo Gadhavi, Mr. Mausam Patatye, Mr. Ajit Ram Vani, Mr. Hamir Chawda, Mr. Vijay Jadeja, Mr. Jitendra Meena, Mr. Virendra S. Khinchi, Mr. Lokinder Singh Rajawat, Mr. Vijay Upadhyay, Mr. Vinod Rawat, Mr. Bhupinder Chowdhary, Mr. Ashok Bhati, Mr. Hiren Mishra, Mr. Jitendra Kumar Gupta, Mr. K.K. Upadhyay, Smt. Halima.
The Ekta Yatra so organized was with the sole motive to strengthen the unity of our nation and to develop the feeling of nationalism and patriotism amongst all Indian and the best day for such an act could not have been other than the Republic Day, the 26th January, the day when India adopted its independent constitution and became a sovereign democratic republic.
However the treatment meted out to the members of the BJYM is very horrifying and is absolutely illegal and contrary to the law of the land and also against the guidelines settled by the Apex Court of the country in a number of judgments.
These members were not only arrested against law and without following any proper procedure but were also illegally detained in the Ram Munshi Police Station in Srinagar and were subjected to 3rd degree treatment and were beaten, slapped ruthlessly. The functionaries of the State Govt. of J&k, including the DGP, SP and SHO had misbehaved with the yatris of the Ekta Yatra and had committed extreme atrocities upon these innocent young people who had assembled in Srinagar after having passed through 57 cities, 12 states and covered almost 3037 kilometres across the country.
It is very unfortunate to mention that these functionaries (CRPF) of j&K has not left any gaps to execute their evil will of preventing these members of the Ekta Yatra from hoisting the National Flag at Lal Chowk at Srinagar, J & K,. These police officials have not only inflicted these innocent yatris with physical harassment but have also dishonoured their individual religious sentiments and have besmirched their pious feelings. They have gone to the extent that they had detained the female members of the Ekta Yatra without following the proper procedure and the guidelines laid down by the Hon’ble Supreme Court of India. Quite contrary to the legal principles the female members of the Yatra were beaten up and slapped by the male officers and were subjected to abusive and filthy language unbecoming the dignity and self esteem of a lady.
These police officials are required to be taken into strict account for their misconduct and their act against the National Honour of India by disgracing the national Flag and violating the human rights and fundamental rights of the members of the Ekta Yatra.
Therefore BJYM have come forth to protest against the arbitrary and illegal action of the State Govt. and its functionaries seeking immediate warrant of the National Human Rights Commission with the following prayers;
I. That a detailed investigation has to be ordered immediately to look into the matter and investigate the matter thoroughly and the guilty police officials should be made to account for their actions ;
II. That a serious human rights violation proceeding should be initiated against the guilty respondents and they should be committed to appropriate punishment for the same.
III. That the respondents may be called upon to show cause as to such atrocious behaviour and narrate cogent explanation of such 3rd degree treatment meted out to members of the petitioner organization.
IV. That the respondents have to be made heavily accountable for such seditious behaviour and for violating the human rights principles.
V. That the injured members ought to be compensated for physical and mental harassment caused by the respondent officials without any cogent reason or explanation and in violation of the laws and rules.
It is expected that a thorough investigation will bring out the truth of the incident at Srinagar on 26th of January and the guilty shall be taken into account and will be strictly dealt with under the legal boundaries and the principles of the Constitution.
